Terms of Service

These terms govern your use of the pdpspectra.com website. Services we deliver under a separate engagement contract are governed by that contract's terms, not these.

1. Acceptance of these terms

By accessing or using pdpspectra.com (the “website”), you agree to be bound by these Terms of Service. If you do not agree, do not use the website.

2. About pdpspectra

pdpspectra is an international AI, data engineering, and DevOps consultancy with offices in Boston (United States), London (United Kingdom), Sydney (Australia), and Kathmandu (Nepal). The website is operated by pdpspectra and its affiliates.

3. Use of the website

You may use the website for any lawful purpose. You agree not to:

  • Use the website in any way that violates applicable law or regulation.
  • Attempt to gain unauthorised access to any portion of the website or its underlying infrastructure.
  • Scrape, harvest, or otherwise extract data from the website in bulk without permission.
  • Introduce malware, viruses, or other harmful code.
  • Impersonate pdpspectra or any of its employees, contractors, or partners.
  • Submit through the contact form any content that is unlawful, defamatory, or infringing.

4. Intellectual property

All content on the website — including text, code samples, blog posts, design, images, and structured-data schemas — is owned by pdpspectra or its licensors and is protected by copyright, trademark, and other applicable laws.

You may:

  • View, download, and print individual pages for personal or internal business reference.
  • Quote brief excerpts from blog posts with attribution and a link back to the source page.
  • Share links to pages on social media or in correspondence.

You may not, without prior written permission:

  • Republish full articles or substantial portions of the site elsewhere.
  • Use pdpspectra's name, logo, or trade dress in a way that suggests endorsement or affiliation.
  • Use site content to train machine-learning models for commercial deployment.

5. User submissions

When you submit information to us through the contact form, by email, or otherwise:

  • You confirm that you have the right to share the information.
  • You grant pdpspectra a non-exclusive, royalty-free licence to use the information for the purpose of responding to your enquiry, evaluating a potential engagement, and complying with legal obligations.
  • You acknowledge that submitting an enquiry does not create a client relationship or any commitment by pdpspectra to provide services.

6. Content is informational, not professional advice

The blog posts, guides, and other written content on pdpspectra.com are published for informational purposes. They reflect the authors' experience and opinions and are not professional, legal, financial, medical, regulatory, or engineering advice for any specific situation.

Do not act on information found on this website without verifying it against your own circumstances and, where appropriate, consulting qualified professionals. pdpspectra is not liable for actions taken solely in reliance on website content.

Where blog posts reference jurisdictions or regulatory frameworks (NRB, MoHP, GDPR, HIPAA, NRB directives, etc.), we have attempted to be accurate as of the date of publication; regulations change, and we do not undertake to update each post on every change.

7. Third-party links and references

The website contains links to third-party websites and references third-party products and services. We provide these for convenience and do not endorse, control, or take responsibility for third-party content, practices, or availability. Your use of any third-party website or service is governed by that party's terms.

8. Disclaimer of warranties

The website is provided “as is” and “as available,” without warranties of any kind, express or implied. To the fullest extent permitted by law, pdpspectra disclaims all warranties including merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability.

We do not warrant that the website will be free of errors, that defects will be corrected, or that the website or its servers are free of harmful components.

9. Limitation of liability

To the fullest extent permitted by law, pdpspectra and its affiliates, employees, contractors, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the website — including lost profits, lost data, or business interruption — even if pdpspectra has been advised of the possibility of such damages.

To the extent liability cannot be excluded, pdpspectra's total aggregate liability for any claim arising out of or related to the website is limited to GBP 100 (or its equivalent in local currency).

This limitation does not apply to liability that cannot be excluded by applicable law (e.g., liability for fraud or for personal injury caused by negligence in jurisdictions where such limitations are unenforceable).

10. Indemnification

You agree to indemnify and hold harmless pdpspectra and its affiliates from any claim, loss, or damage arising out of your breach of these Terms or your unlawful use of the website.

11. Termination

We may suspend or terminate your access to the website at our discretion, without notice, if we believe you have breached these Terms or if continued access poses a security or legal risk. The provisions that by their nature survive termination (intellectual property, disclaimer, limitation of liability, indemnification, governing law) continue to apply.

12. Governing law

These Terms are governed by the laws of England and Wales, without regard to conflict-of-law principles. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

This governing-law clause applies to website use only. Services delivered under a separate engagement contract have their own governing-law clause, which controls for that engagement.

13. Changes to these terms

We may update these Terms from time to time. The “Last updated” date at the top of the page reflects the most recent revision. Material changes will be flagged on the page; continued use of the website after a change constitutes acceptance of the revised Terms.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full effect.
